Belleville Amateur Baseball Association

The Belleville Amateur Baseball Association (herein referred to as BABA) will attempt to accommodate all interested players. Registration, however, cannot be guaranteed as it is limited and on a “first come, first serve” basis. No player shall move to the next division unless one of the following is met.  Has played 2 years in the previous division (3 if child is in rookie) or birth year has been reached. The child who requests to move up early will also only do so if there is room on a team. BABA reserves the right to move players among teams for the purpose of balancing skill level and ensuring competitive play. Players must wear BABA issued uniforms. Some parts of the uniform may need to be supplied by the player, but must conform to BABA standards. Absolutely no shorts are allowed. A jock strap or jill strap is mandatory. It is the parent/guardian’s responsibility to ensure that the player is in good health and has medical coverage. Returned cheques will result in a $25 charge. For Regular Season Programing the cancellation the deadline is the last saturday in April and is $25. After that there are no refunds for those age groups. For Summer Camp Programing the cancellation the deadline is May 31 and is $25. After that there are no refunds. For Off-Season Programing the cancellation the deadline is Aug 31 and is $25. After that there are no refunds. Registrants will not be registered for any activity if there are any outstanding fees from previous activities.  Requests can be made for coaches or friends, but this is not a guarantee. The only guarantee made is that siblings in the same division will be placed on the same team.

In consideration of my granting permission for my child (player named above) to join the BABA and play baseball therewith, on behalf of myself, my family, heirs, successors, and executors hereby indemnify and hold harmless the BABA, its league executive officers, successors and volunteers from all costs, claims, actions, damage, or liabilities, whatever their nature or however caused, resulting from participation of the player in any activities of the BABA, Permission is hereby granted to the BABA and its volunteers to seek medical and/or hospital care for my child if and when such case is deemed necessary.

Belleville Baseball Registration, Privacy Assurance and Consent

WHAT IS THIS PRIVACY ASSURANCE FOR?

Belleville Baseball’s Privacy Assurance provides an overview of our privacy principles and practices and seeks your consent to the collection, use and disclosure of your personal information in the course of providing our programs and services. Further details about our privacy principles and practices may be found in our Privacy Policy available online at playoba.ca. To the extent of any conflict between this Privacy Insurance and the Privacy Policy, the Privacy Policy shall prevail.

PROTECTION OF PERSONAL INFORMATION

Belleville Baseball strives to protect and respect personal information of its customers, employees, business partners, and so on in accordance with all applicable provincial and federal laws. The Privacy Policy applies to all Personal Information within Belleville Baseball’s possession and control.

WHAT IS PERSONAL INFORMATION

We consider “Personal Information” to mean any information about an identified individual or an individual whose identity may be inferred or determined from such information, including name, date of birth, address, phone number, e‐mail address, birth certificate number, etc., other than business contact information (e.g. name, title, business address, business telephone number). The Privacy Policy does not cover aggregated data from which the identity of an individual cannot be determined. Baseball Ontario retains the right to use aggregated data in any way that it determines appropriate.

WHY BELLEVILLE BASEBALL MAY COLLECT PERSONAL INFORMATION

Belleville Baseball collects and uses Personal Information solely for the purpose of conducting its operations and offering its programs and services to players, coaches, umpires and member associations.

The personal information we ask for will depend upon which services you may be interested in obtaining.

HOW BELLEVILLE BASEBALL COLLECTS AND USES PERSONAL INFORMATION

Consent to the collection occurs and is obtained when an individual signs (including electronic submission) an application or other form containing Personal Information, thereby authorizing Belleville Baseball to collect, use and disclose the individual’s Personal Information for the purposes stated on the form or in the Why Belleville Baseball May Collect Personal Information section of the Privacy Policy.

CONSENT

Unless permitted by law, no Personal Information is collected, without first obtaining the consent of the individual concerned, for the collection, use and dissemination of that information. However, we may seek consent to use and disclose Personal Information after it has been collected in those cases where Belleville Baseball wishes to use the information for a purpose not identified in The Privacy Policy or not previously identified or for which the individual concerned has not previously consented.

By providing Personal Information to Belleville Baseball you agree and consent that we may collect, use and disclose your Personal Information in accordance with The Privacy Policy. In addition, where appropriate, additional authorizations or consents may be obtained from time to time.

In most cases and subject to legal and contractual restrictions, you are free to refuse or withdraw your consent at any time upon reasonable, advance notice. It should be noted that in certain circumstances, certain services can only be offered if you provide Personal Information to Belleville Baseball. Consequently, if you choose not provide us with any required Personal Information, we may not be able to offer you the services requested. We will inform you of the consequences of the withdrawal of consent.

THE ACCURACY AND RETENTION OF PERSONAL INFORMATION

We keep your Personal Information only as long as it is required for the reasons it was collected. The length of time we retain information varies, depending on the service and the nature of the information. This period may extend beyond the end of a person’s relationship with us but it will be only for so long as it is necessary for us to have sufficient information to respond to any issues that may arise at a later date.

When your Personal Information is no longer required for Baseball Ontario’s purposes, we have procedures to destroy, delete, erase or convert it into an anonymous form.

WE LIMIT DISCLOSURE

We do not disclose your personal information to third parties except as described in the Privacy Policy or as permitted or required by law, unless such disclosure is required in order to provide a participant or member organization with our services.

Please note that there are circumstances where the use and/or disclosure of Personal Information may be justified or permitted or where Belleville Baseball is obliged to disclose information without consent. Such circumstances may include:

  • Where required by law or by order or requirement of a court, administrative agency or governmental tribunal;
  • Where Belleville Baseball believes, upon reasonable grounds, that it is necessary to protect the rights, privacy, safety or property of an identifiable person or group;
  • Where it is necessary to establish or collect monies owing to Belleville Baseball; Where it is necessary to permit Belleville Baseball to pursue available remedies or limit any damages that we may sustain; or Where the information is public.
  • Where obliged or permitted to disclose information without consent, Belleville Baseball will not disclose more information than is required.

Belleville Baseball does not sell, trade or barter Personal Information.

RESOLVING YOUR PRIVACY CONCERNS

In the event of questions about: (i) access to your Personal Information; (ii) our collection, use, management or disclosure of Personal Information; or (iii) The Privacy Policy; please contact Belleville Baseball by sending an e‐mail to bellevillestorm@gmail.com or calling 613-661-5687. Belleville Baseball will investigate all complaints and if a complaint is justified, we will take all reasonable steps to resolve the issue.

LIABILITY WAIVER

On behalf of myself and the player being registered, I recognize that baseball entails serious risks. Consequently, except as noted below, I and the player being registered relinquish all rights to a claim of any kind, including the right to a claim for bodily and material damages, regardless of the cause, against Belleville Baseball, its member associations, including the local association and their respective officers, employees, coaches, umpires, assignees, agents, representatives, and sponsors, even if such damages result from negligence of Belleville Baseball, its member associations, including the local association and their respective officers, employees, coaches, umpires, assignees, agents, representatives, and sponsors.

Without restricting the generality of the preceding, I and the player being registered also relinquish the right to any claim against Belleville Baseball, its member associations, including the local association and their respective officers, employees, coaches, umpires, assignees, agents, representatives, and sponsors resulting from a decision on their part, regardless of the nature of this decision.

This release of Belleville Baseball, the local association and the other persons noted above does not preclude myself or the player being registered from making a claim under any sports accident coverage provided by Belleville Baseball and/or the local association to their players. I authorize my local association and/or their respective staff, associates, assistants, or subcontractors to use photograph(s), video and other media image provided for any local association promotional, educational or other pertinent uses. I also agree to my local association using any images of the named minor(s) gathered by photographers, and or videographers supplying images to my local association. These images may include, but are not exclusive to, club, coach, athlete and/or parent, and/or volunteer submissions by various member associations of my local association. I authorize my local association to permit the use and display of photographs and/or recordings of the named minors in any local association publication, multimedia production, including video and web usage, display, or advertisement. I agree that local association may use name, likeness, or information supplied by the undersigned. The undersigned releases and forever discharges my local association and their respective officers and employees from any and all claims and demands arising out of or in connection with the use of said photographs / recordings, including but not limited to, any claims for invasion of privacy or defamation.

ROWAN’S LAW

Under Rowan’s Law, before any player can be registered, the player, and the parent or legal guardian of the player if the player is under 18 years of age, must review one of the Concussion Education Resources provided by the Province of Ontario and must review the Player Code of Conduct.
